24. Cellular DAS & Public Safety DAS (ERRCS) Special Terms & Conditions
24.1 Rough Order of Magnitude (ROM) & iBwave Engineering Design
-
a. ROM Non-Binding Status: Any Rough Order of Magnitude (ROM) provided for Cellular Distributed Antenna Systems (DAS) or Public Safety Emergency Responder Radio Coverage Systems (ERRCS) is a preliminary budgetary estimate only and does not constitute a binding, fixed-price agreement.
-
b. Site Survey & iBwave Fees: Upon ROM acceptance, CMC Communications, LLC (“Company”) will perform a physical site survey, exterior roof RF readings, link budget calculations, and a 3D iBwave RF heatmap design. Customer agrees to pay the upfront site survey and iBwave design fee specified in the ROM. Deliverables include iBwave coverage heatmaps, wiring diagrams, and a complete Bill of Materials (BOM).
-
c. Fee Application & Cancellation: If Customer cancels the project prior to accepting the firm quote, all survey and iBwave engineering fees remain 100% non-refundable. If Customer accepts the firm quote, 100% of the paid site survey and iBwave engineering fee will be applied as a credit toward the final contract balance.
25. Active Signal Sources (Small Cells / Super Cells) & ISP Obligations
If initial RF readings or high-density user requirements indicate that macro RF signal levels are inadequate, active signal sources (such as Carrier Small Cells, Super Cells, or CBRS headends) will be required and quoted separately. Customer is solely responsible for providing dedicated WAN/ISP internet backhaul circuits, static IP addresses, clean primary AC power, and for paying all ongoing third-party carrier, monitoring, maintenance, and ISP service fees.
26. Wireless Carrier & FCC Part 90 Approval Contingencies
-
a. Retransmission Consent: All Cellular DAS installations require formal retransmission consent from wireless service providers (AT&T, Verizon, T-Mobile). Public Safety BDAs require registration and authorization under FCC Part 90 and written consent/letters of concurrence from the local frequency license holder.
-
b. Carrier-Mandated Design Changes: If a carrier or frequency licensee requires design alterations, additional band-pass filtering, attenuated donor antenna configurations, or hardware upgrades prior to granting retransmission authority, Customer accepts full financial responsibility for all resulting labor, parts, and engineering changes. The firm quote will be updated via Change Order.
-
c. Third-Party Delays: Company is not liable for project schedule delays, occupancy delays, or financial losses caused by carrier administrative backlogs, spectrum coordination delays, or frequency holder approval timelines.
27. Authority Having Jurisdiction (AHJ) & Life Safety Code Compliance
-
a. AHJ Authority & Final Acceptance: Public Safety ERRCS installations are strictly regulated by the local Fire Marshal or Authority Having Jurisdiction (AHJ) under IFC 510, NFPA 1225/72, and local amendments. Final system acceptance, grid-testing approval, and Certificate of Occupancy (CO) sign-offs are strictly at the discretion of the AHJ.
-
b. Code Changes & Re-Grid Testing: If the local AHJ mandates additional coverage zones, modifies frequency channel assignments, or enforces revised local building codes after contract execution, any additional labor, testing, or equipment required will be billed to Customer via Change Order.
-
c. FACP Integration & Electrical Infrastructure: Customer is responsible for ensuring existing building infrastructure—including the Fire Alarm Control Panel (FACP) monitoring modules, dedicated 120VAC electrical circuits, and 2-hour fire-rated pathways—meets NFPA/IFC requirements unless explicitly line-itemed in Company’s scope.
28. Macro Environment & Structural RF Alterations Disclaimer
Company engineers DAS networks based on ambient RF conditions present on the day of the initial survey. Company accepts no liability or financial responsibility for post-survey RF signal degradation caused by external or structural factors, including but not limited to:
-
Changes in external macro cell tower azimuths, tilt, power outputs, or frequency band shutdowns/re-farming by cellular carriers.
-
External physical obstructions erected near the property (e.g., new buildings, metal structures).
-
Post-design internal building modifications, such as the installation of Low-E energy-efficient glass, metallic wall insulation, dense drywall partitions, or structural layout changes that block RF propagation.
29. Mandatory Annual Recertification & Maintenance Exclusion
Under national fire codes (NFPA 1225 / IFC 510), Public Safety DAS installations require annual inspection, battery load testing, and RF grid recertification. Initial turnkey installation contracts do NOT include ongoing annual recertification, emergency service response, or routine maintenance unless explicitly executed under a separate written Preventive Maintenance Agreement.
30. Limitation of Liability & Consequential Damages
To the maximum extent permitted by law, Company shall not be liable to Customer or any third party for any indirect, incidental, consequential, special, or delay damages—including loss of business profits, delayed building occupancy permits, regulatory fines, or cellular/radio signal outage—arising out of or related to the DAS design, installation, or regulatory approval process. Company’s maximum aggregate liability shall not exceed the actual fees paid by Customer to Company under the specific statement of work.
